Section 1031 Exchanges
The name Section 1031 exchange is named after the Tax Code Section 1031 which provides a blueprint for exchanging properties with “like-kind” properties while deferring tax until the property is sold later (unless another section 1031 exchange is conducted). This allows taxpayers to defer the tax on built in gain which otherwise would be taxed immediately and also allows taxpayers to defer the depreciation recapture when the property is sold.
