The End of Catch and Release: What the Big Beautiful Bill Means for Immigrants

The long-standing immigration practice known as "Catch and Release" might officially be coming to an end. The recently enacted One Big Beautiful Bill—a sweeping federal immigration and border enforcement law—marks a seismic shift in how the United States handles non-citizens encountered at or near the border.

On July 4, 2025, President Donald J. Trump signed into law a sweeping, nearly 900-page piece of legislation that spans a wide range of issues—from Medicaid to immigration. This far-reaching law carries profound, long-term implications and marks a significant setback for America's standing on the global stage.  While this law touches nearly every facet of American life, this brief blog post will focus solely on one critical issue: the potential for prolonged detention of immigrants under its provisions.

According to Section 90003 of the bill, titled "DETENTION CAPACITY[,]" Congress has authorized $45 Billion or the construction and expansion of single adult detention facilities and family residential centers.  

These facilities are authorized to detain immigrants—including women and children—for the entire duration of their immigration proceedings. In other words, the government now has the power to detain any noncitizen involved in removal or related immigration proceedings, potentially for years, until a final decision is reached.

Imagine a lawful permanent resident (green card holder) facing removal for something as minor as a single DUI or based on unfounded domestic violence allegations. Under this new law, even that individual—despite years of lawful presence—could be locked away in a detention facility indefinitely, without the guarantee of release while their case is pending.
